Have you ever been phished or hacked because your data is available to scammers? A new law makes you—as consumer or vendor– safer from cyber predators. To provide more protection for your content and data, a new agency has been created.
The law is the California Privacy Rights Act (CPRA).
The new law which began enforcement on July 1, 2023 provides for more protection for consumers and data protection requirements for companies serving at least 100,000 California households.
The new rules prohibit businesses from retaining personal information “longer than absolutely necessary.”
Deleting data is a contentious issue. There are legal holds and other regulatory and compliance requirements to retain data.
Further, if a company shares data with any business partners they (the partners) must also comply with the CPRA. Since part of the law involves having reasonable cybersecurity measures in place.
Under the new CPRA individual consumer mid-sized companies are going to be particularly hard hit. For companies with less than $25 million in annual revenues, the requirements are less onerous. On the plus side, many companies will take advantage of this new law to demonstrate to their customers that they are “in compliance” and looking out for consumers privacy rights.
